Representative Engagements

  • Obtained a judgment for more than $400,000 in a jury trial asserting claims for breach of contract and fraud in the sale of a winery.
  • Appealed the trial court's denial of a motion to strike under California's anti-SLAPP statute resulting in the reversal of the trial court.
  • After successfully defending a professional malpractice case proceeded with an appeal of the damage calculation in this case resulting in a published decision interpreting the application of damages in a good faith settlement.
  • Received the largest settlement ever paid by a junior college to a dismissed employee.
  • Was one of the lead attorneys in a case involving the loss of tens of millions of dollars by more than 5,000 depositors in failed thrifts in Utah. After filing suit and negotiating with the State of Utah, its insurance carriers and other financial institutions, the depositors received a settlement exceeding $44,000,000.

Douglas Provencher

Mr. Provencher applies thirty years of experience to solving his clients' problems and disputes. His experience includes representing individuals, small and large businesses in contract disputes, insolvency cases, professional liability lawsuits and real estate issues. He has tried numerous jury and court cases in both state and federal courts. He has also brought and defended several motions to dismiss under California's anti-SLAPP stature.

Mr. Provencher is certified by the California State Bar as a specialist in Bankruptcy Law. He conducts a monthly backruptcy workshop for low-income persons through the Santa Rosa office of the California Rural Legal Assistance office.
